Acceptance of Terms

By accessing or using DSE123 (the Application), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Application. These terms constitute a legally binding agreement between you and the developer of DSE123.

Description of Service

DSE123 is a free, open-source, web-based clinical decision support tool designed to assist with dobutamine stress echocardiography (DSE) workflows. The Application provides structured data entry, automated hemodynamic calculations, protocol guidance, and PDF report generation for stress echocardiography studies.

The Application operates entirely client-side in the users browser. It does not store, transmit, or process patient data on any remote server.

Intended Users

DSE123 is intended for use by licensed medical professionals, including but not limited to cardiologists, cardiac sonographers, echocardiography fellows, and other qualified healthcare providers with appropriate training in stress echocardiography.

The Application is not intended for use by patients, the general public, or individuals without appropriate medical training and clinical context.

Not a Medical Device

DSE123 is a clinical workflow and calculation aid. It is not a registered, cleared, or approved medical device under any jurisdiction. It has not been evaluated by the U.S. Food and Drug Administration (FDA), European Medicines Agency (EMA), or any other regulatory body. It should not be used as the sole basis for any clinical decision.

No Warranty

THE APPLICATION IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

The developer does not warrant that the Application will be uninterrupted, error-free, or free of harmful components. No guarantee is made regarding the accuracy, completeness, or reliability of any calculations, outputs, or generated reports.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APPLICATION.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if the developer has been advised of the possibility of such damages.

User Responsibilities

As a user of DSE123, you agree to:

  • Independently verify all calculations and outputs before making clinical decisions
  • Review all generated reports for accuracy and completeness before clinical use
  • Use the Application only within your scope of professional competence and licensure
  • Not rely on the Application as a substitute for professional medical judgment
  • Comply with all applicable laws, regulations, and institutional policies
  • Report any errors, inaccuracies, or bugs to the developer

Intellectual Property

The DSE123 source code is released under the MIT License and is freely available for use, modification, and distribution in accordance with that license.

The DSE123 name, logo, branding, and visual identity are proprietary and may not be used without prior written permission from the developer. Use of the open-source code does not grant rights to the DSE123 brand or trademarks.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of the Application after any modifications constitutes acceptance of the revised terms. It is your responsibility to review these terms periodically.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or relating to these terms or the use of the Application shall be subject to the exclusive jurisdiction of the courts in India.
